Terms of Service

These Terms of Service ("Terms") govern access to and use of the Kreel Service ("Service") provided by Beyond Peaks ("Kreel", "we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.

1. The Service

Kreel provides a unified data layer that connects ecommerce and marketing platforms (including Shopify, Klaviyo, Meta Ads, and Google Ads) and exposes the resulting data via an API, CLI, and MCP server surfaces.

2. Accounts

• You must provide accurate account information and keep it current.
• You are responsible for all activity under your account and for safeguarding your credentials and API keys.
• You must be at least 16 years old to use Kreel.

3. Your content and connected accounts

Your data, the data of end users you manage, and the content you connect via third-party platforms remain your property. You grant Kreel the limited rights needed to operate the Service on your behalf (storage, processing, display in your workspace, transmission to the agent surfaces you explicitly configure).

You are responsible for having the necessary rights to connect and process data from platforms you integrate with Kreel.

4. Acceptable use

You will not:

• Reverse-engineer, scrape, or resell the Service.
• Use the Service to violate any law or the terms of any connected platform.
• Attempt to access data outside your workspace or interfere with the Service.
• Use the Service to send spam or unsolicited communications.

5. Plans and billing

• Paid plans are billed monthly or annually via Stripe. Prices are listed at kreel.ai/pricing.
• Fees are non-refundable except as required by law. Annual plans may be cancelled for the end of the current term.
• We may change prices by giving 30 days' notice.
• Overage rules and call limits per plan are published on the pricing page.

6. Third-party platforms

When you connect third-party platforms (Shopify, Klaviyo, Meta, Google), your use of those platforms through Kreel is also subject to their own terms. Kreel is not responsible for actions taken by those platforms or for changes to their APIs.

7. Confidentiality

Each party will protect the other's confidential information with at least the same care it uses for its own, and will not disclose it except to personnel who need it to perform under these Terms.

8. Suspension and termination

We may suspend or terminate access if you breach these Terms, fail to pay, or if required to comply with law. You may cancel at any time from your workspace or by contacting support. On termination, your connected-platform data is deleted per our Privacy Policy.

9. Warranties and disclaimers

The Service is provided "as is" without warranties of any kind, except to the extent prohibited by law. We do not guarantee that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, Kreel's aggregate liability under these Terms will not exceed the fees paid by you in the 12 months preceding the event giving rise to liability. Kreel will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data.

11. Indemnity

You will indemnify Kreel against third-party claims arising from your breach of these Terms, your content, or your unlawful use of the Service.

12. Governing law

These Terms are governed by the laws of France. Any dispute will be resolved by the competent courts of Paris, France, without prejudice to mandatory consumer protections.

13. Changes

We may update these Terms. Material changes will be notified at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
